These Terms and Conditions constitute a legally binding contract between the customer (you) and Biovite Australia Pty Ltd (ACN 097 058 743) (Biovite or We) and apply to the ordering purchase, fulfilment and delivery of goods (Goods) from nailkalm.com (the Website). By placing an order for Goods from Biovite you agree to these Terms and Conditions.

Please read the following Terms and Conditions carefully before placing your order. The Terms and Conditions contain important information about the ordering, processing, fulfilment and delivery of Goods.

1. Ordering

1.1 Placing an order

You can place an order for Goods (Order) on the by following the instructions on the Website for the specified price plus the delivery charge as shown at the time of submission of your Order (see further below for delivery charges) and that comprises an offer from you to purchase Goods. Biovite may accept or reject your offer, including orders for commercial quantities of Goods. 1.2 Order Acceptance

Each Order that you place will, if accepted by Biovite, be a separate and binding agreement between you and Biovite with respect to the supply of the relevant Goods, in accordance with these terms and conditions.

Where you place separate Orders, the Goods will be delivered separately and a separate delivery charge will apply to each Order. Biovite cannot consolidate separate Orders into one delivery.

1.3 Providing Information

Please ensure that you enter all information carefully when placing an Order. Biovite relies on you that all information provided by you in relation to each Order is complete, true and accurate.

Please check your Order carefully (including the quantities ordered) before submitting it.

Except to the extent otherwise required by law (including, without limitation, the Australian Consumer Law), Biovite will not be liable to you, or any other person, for any loss, damage, cost or expense suffered as a direct or indirect result of your Order information being incomplete or inaccurate or as a result of being unable to change or cancel your Order once it has been accepted by Biovite, whether in contract, negligence or otherwise.

2. Cancel or modify an order

Before you place your order, you can view the contents and the total amount in your shopping basket. Once your order has been submitted successfully, the order will be in an "On Process" status. Your order is then "Sent" entering the shipping process immediately.

The only time that you can cancel or modify your order is during "On Process" status. Once your order enters the shipping process by being "sent", no further changes can be made. You must call a Customer Service Representative on + 61 7 5520 7544 to make any changes to your order when it is in "On Process" status. If the order has been "Sent," we are unable to cancel or modify your order. 3. Payment and Prices

3.1 Payment

Biovite will process payment for your Order when, or shortly after, you place your Order. Your Order is deemed to be accepted by Biovite does this.

You must pay for Goods by credit card (Visa or Mastercard) or PayPal. Biovite is not responsible to you if the name on the credit card/payment does not match the name on the Order. Nevertheless, Biovite is entitled to ask you to provide additional information such as proof of identity. By providing your credit card/payment card Biovite to deduct the price and the applicable delivery charge(s) from such card.

3.2 Prices

Payment will be processed at the price for the Goods appearing on the Website at the time of placing your Order. In addition to the price payable for the Goods, there are shipping prices as follows:

(a) For domestic delivery (within Australia): shipping cost will be at a flat rate of AUD $X for any size domestic order.

(b) For overseas delivery: shipping cost will be as per Australia Post cost for international orders.
